It is your responsibility to consider the Policy each time you utilise our website and/or services or products. Where we refer to “Personal Information” in this Policy, we mean personal information as defined in Applicable Law, being information that may be used to directly or indirectly identify you. Personal Information includes, for example, your name, surname, email address, identity number, contact details, photograph and location. In terms of POPIA, personal information is inclusive of juristic entities. In terms of the GDPR, it is not.

 

 

  1. PERSONAL INFORMATION WE COLLECT FROM YOU

 

  • Should you decide to utilise our Website, engage with us, work with us and/or use any of our products or services, you thereby expressly consent to, and opt-in to Hyve Digital collecting, collating, processing, and using the following types of information about you (“personalinformation”):


3.1.1. Information provided by you or from another responsible party authorised by you:

 

Hyve Digital processes personal information, provided by you, that you choose to submit to us (that is information about you that is directly or indirectly personally identifiable, as defined in POPIA or the GDPR, like, for example but not limited to, your name, identification number, address, email address, company name, company registration number, contact details, phone numbers etc.) which Hyve Digital either processes as its own responsible party, or which is received from another responsible party to whom you have provided your personal information with your permission to be shared with Hyve Digital as the operator. This includes information provided at the time of using our website or requesting further services/products. We may also ask you for information when you report a problem with our website. If you contact us, we may keep a record of that correspondence;


3.1.2. Information that is collected automatically:


Hyve Digital receives and stores information which is transmitted automatically from a user’s computer when the user browses the internet and accesses the website. This information includes information from cookies (which are described in clause 12 below), the user’s Internet Protocol (“IP”) address, browser type and version, embedded web links, geographical location, log files and other information-gathering tools. These tools collect certain standard information that your browser sends to the website such as your browser type and language, times of access, and the address from which you arrived at the website.

 

3.1.3. Information from public sources:

 

Hyve Digital collects, collates and processes personal information from public sources when you have engaged with us and made your personal information public, such as on social media.

Hyve Digital will, however, not be able to update any personal information of yours attained from another responsible party. You also warrant that any personal information provided to us from a third-party responsible party, was attained from you lawfully and provided to us with your express consent to the relevant responsible party to do so. You warrant further that Hyve Digital shall be entitled to process any information that we obtain about you in terms of this Policy without seeking any further permissions or consents from you and/or any third parties.

 

  • You warrant further that none of the personal information you submit to us is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or obtained unlawfully and that needs to be corrected or deleted (“defective information”). You also accept that Hyve Digital cannot be held responsible for using defective information where it is not aware of the nature and extent of the defects in such information.

However, our contracts dictate that these service providers may only use your information in connection with the services they perform for us, not for their own benefit and under the same standards as how we operate.

Your job role, organisation and some or all of your comments may be publicly displayed on our website as a testimonial. 6.2.7.1 provide you with non-marketing correspondence via Whatsapp, digital media platforms, telephone, social media and email as you have given us your consent to this;


6.2.7.2 contact you when requested by you or in relation to a service or product we are providing you;


6.2.7.3 process your website-use data to analyse how you use our website and services/products. This allows us to provide a browsing experience which is relevant to you;

  • Hyve Digital’s website and the services/products available through its website, may contain links to other third party websites, including, but not limited to, social media platforms, payment gateways, appointment scheduling and/or live chat platforms. If you select a link to any third party website, you may be subject to such third party websites terms and conditions and/or other policies (including privacy policies), which are not under the control, nor responsibility, of Hyve Digital.

 

  • Hyperlinks to third party websites are provided “as is” and Hyve Digital does not necessarily agree with, edit, endorse or sponsor the content on these third party websites.

 

  • Hyve Digital urges users to evaluate the security and trustworthiness of any third party website before disclosing any personal information to them. Hyve Digital does not accept any responsibility for any loss or damage in whatever manner, however caused, resulting from your disclosure to third parties of personal information.

 

  1. ORIGINAL AND UPDATED PURPOSES FOR PROCESSING

 

Hyve Digital will only use your personal information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us. If we need to use your personal information for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

9.1.1 Our third-party service providers and processors in order to provide you with access to the website and/or products/services, in accordance with written agreements with these third parties;

 

9.1.2 Legal and regulatory authorities, upon their request, or for the purposes of reporting any breach of applicable law;

 

9.1.3 Accountants, auditors, lawyers and other external professional advisors in terms of written agreements with them;

 

9.1.4 Any relevant party to the extent necessary for the establishment or defence of legal rights, criminal offences, threats to public security etc; and

 

9.1.5 Any relevant third party if we sell or transfer all or any portion of our business or assets; and

 

9.1.6 Any relevant third party provider where our website uses third party advertising, plugins or content.

 

  • If we engage third-party processors to process your personal information, the processors will only be appointed in terms of a written agreement which will require the third party processors to only process personal information in terms of our mandate, use appropriate measures to ensure the confidentiality and security of your personal information and comply with other requirements as set out in this agreement and required by POPIA, the GDPR and other Applicable Law.

 

  • Due to the fact that we are not responsible for any representations or information or warranties or content provided by third parties, even where such third parties are our clients, we do not exercise control over such third parties’ privacy policies and you should refer to the privacy policy of any such third party to establish how such third party protects your privacy.

 

 

  1. STORING OF PERSONAL INFORMATION AND INTERNATIONAL DATA TRANSFERS

 

 

  • Due to the nature of the services/products and our business being established in different countries and us working with business partners and service providers in different countries, we may need to transfer personal information to and from the different countries for internal business purposes.

When we use storage outside of South Africa (or the United Kingdom), it is in data centers which are POPIA or GDPR compliant.

10.3.1 Is in accordance with this Policy;

10.3.2 includes provisions that are substantially similar to what is contained in this privacy policy regarding the further transfer of your data.

  • All information you provide to us is stored on our secure servers and/or on our chosen cloud storage solutions. All our development machines are encrypted to hard drive level and our development cluster is encrypted to the operating system level. All backups to external hard drives are also encrypted. Where we have given you (or where you have chosen) a password which enables you to access our servers, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

 

  • Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal information, we cannot guarantee the security of your data transmitted to us and any transmission is at your own risk. Once we have received your personal information, we will use strict procedures and security features to try to prevent unauthorised access.

 

  • Should you submit personal information for publication on the website, whether by way of a testimonial, article or for any other purpose, you acknowledge that this will be published on the internet and may be available, via the internet, around the world. While we cannot ensure or warrant the security of any personal information you provide us, we will continue to maintain and improve these security measures over time in line with industry best practices and legal/ technological developments;


12.2.3 provide you with reasonable access to your personal information to view and/or update personal details;


12.2.4 promptly notify you if we become aware of any unauthorised use, disclosure or processing of your personal information;


12.2.5 provide you with reasonable evidence of our compliance with our obligations under this Policy on reasonable notice and request; and

  • You are entitled to request access to any relevant personal information held by Hyve Digital where such access is necessary for you to exercise and/or protect any of your rights. For any personal information held by any third-party responsible party, you must approach that responsible party for the realisation of your personal information rights with them, and not with Hyve Digital.

 

  • Under POPIA and the GDPR, you have rights in relation to your personal information. Please contact us to find out more about these rights or enabling them. They include having the right to:


  13.2.1 have your data processed in a fair, lawful and transparent way;


13.2.2 be informed about how your personal information is being used, as is covered in this Policy;


13.2.3 access personal information we hold about you;


13.2.4 require us to correct any mistakes in your personal information;


13.2.5 require us to delete personal information concerning you in certain situations where there is no good reason for us to continue to process it;


13.2.6 data portability with is the right to request that we transfer your personal information to you or another service provider in a simple, structured format;


13.2.7 object at any time to the processing of your personal information for direct marketing purposes;


13.2.8 object to automated decision making which produces legal effects concerning you or similarly significantly affects you;


13.2.9 object in certain other situations to our continued processing of your personal information; and/or

  1. HYVE DIGITAL’S RIGHTS RELATING TO PERSONAL INFORMATION

 

  • Hyve Digital will disclose the user’s personally identifiable information if it reasonably believes that it is required to do so by law, regulation or other government authority or to protect the rights and property of Hyve Digital or the public. Hyve Digital may also co-operate with law enforcement in any official investigation and may disclose the user’s personally identifiable information to the relevant agency or authority in doing so.

 

  • Hyve Digital also reserves the right to retain on our records information you have requested be removed from our active databases for certain purposes, such as to resolve disputes. Please also note that information submitted to us by you may in some instances never be completely removed from our databases due to technical and legal constraints.
